48. Arman Suleymanyan vs. the RA Civil Court of Appeal

The journalist from civilnet.am Arman Suleymanyan since May 2014 has covered court case number ԼԴ/0514/02/11 in the RA Civil Court of Appeal about the custody of the RA citizen David Hakobyan’s six-year-old son. The court case has been examined openly. But during the publication of decision the court prohibited the journalist to videotape the publication of the concluding part of the decision without any argumentation.

The journalist thought that the judges had broken his right for freedom of information and taking into consideration his profession and the fact that he wanted to videotape the publication of the concluding part of the decision during his professional activity, they had also broken the society’s right to freedom of information. The journalist applied to the “Freedom of information center” for receiving legal aid.

On December 30, 2014 the journalist Arman Suleymanyan with the support of the FOICA applied to the RA Administrative court with the claim to recognizing the court’s (judges’) action (inaction) as unlawful and to oblige of providing information for giving legal appraisal to the actions of the RA Civil Court of Appeal (judges).

With the decision by February 20, 2015, the RA Administrative court declined the reception of the claim of Arman Suleymanyan. The journalist with the support of the FOICA applied the decision of the RA Administrative court to the RA Administrative Court of Appeal.
