42. The FOICA vs. the "Parking City Service" CJSC

On November 21, 2013, the Freedom of Information Center sent a written information request to the the "Parking City Service" CJSC asking to provide information about the cameras at the paid parking of Yerevan, including the copies of legal acts (law, decree, order, etc.), which served as a basis for placement of each camera at the paid parking of Yerevan. But the CLSC has refused to provide the asked information, claiming that the company is not a public company, because it does not provide services to the public and don't have an obligation to provide information.

On December 26, 2013, the FOICA filed a suit at the RA Administrative Court against the "Parking City Service" CJSC. The FOICA has asked the Court to recognize the fact of violation of the FOICA's freedom of information right, oblige the respondent to provide the requested information, and to impose an administrative penalty on the director of the "Parking City Service" CJSC Vazgen Harutunyan.

As a result of the court proceeding, which lasted until August 14, 2015, the RA Administrative Court rejected the FOICA's claim. The FOICA appeald the court's decision to the RA Administrative Court of Appeal. The first court hearing in the RA Administrative Court of Appeal took place on March 3, 2016. The next court hearing took place on March 30. The Court publishեed its decision on April 19, 2016, by which rejected the FOICA's appeal and left the decision of the RA administrative Court in force. On May 23, 2016, FOICA applied to the RA Court of Cassation. The RA Court of Cassation rejected the adoption of FOICA's appeal.
