58. FOICA vs. Police

On December 4, 2020 Freedom of Information Center of Armenia sent a request to the
Personal Data Protection Agency of the Ministry of Justice of the Republic of Armenia, asking for a consultation.
On November 24, 2020 Freedom of Information Center sent a request to the Police of RA asking to provide information and give a list how many legal entities and physical identities have been fined in RA on the bases of violation of restrictions on freedom of speech by November 25, 2020 based on martial law adopted on September 27, 2020 indicating the amount of each penalty.
The Police referring to the Article 8, Part 1, Clause 2 of the RA Law on Freedom of Information, refused to provide the list of fined persons, noting that ‘(...) information on the mentioned part is refused as it will violet the privacy right of the media (fined) protected by law.’
Due to Article 24, Part 3, Clause 15 of the RA Law on Personal Data Protection, the FOICA asked the Police to give a consultation on existing legal arrangement practice concerning requests to provide personal data or being refused.
